No decision in LabCorp v. Metabolite today.  Maybe this Thursday, when the Court hands down more decisions.

The Court did, however, act today in SmithKline Beecham v. Apotex, S. Ct. 05-489, denying the petition for review.  The Federal Circuit’s analysis of anticipation by inherency in the case stands, at least for now.
